StemExpress MyChart Terms and Conditions

Statement of Participation

By signing this agreement, I acknowledge that I am requesting access to portions of my health information and the ability to communicate with StemExpress concerning my health information via the Internet using an electronic application called MyChart.

Use of StemExpress MyChart for Healthcare Services

I understand that StemExpress MyChart should never be used for urgent matters. The anticipated turnaround time for response to electronic messages is 1 to 2 business days. Therefore, for all urgent matters that I believe may immediately affect my health or well-being, I will, without delay, contact StemExpress by phone, and/or go to the emergency department of a local hospital, and/or dial 911.

I understand that StemExpress may send me messages via MyChart. These messages may contain information that is important to my health and medical care. It is my responsibility to monitor these messages. By entering my valid and functional email address I have enabled StemExpress to notify me of messages sent to MyChart Inbox. I understand that any person with access to my email account will see these MyChart notifications. I will update my email address on StemExpress MyChart as needed. I agree not to hold StemExpress, hereafter known as the “Service Provider,” liable for any loss, injury or claims of any kind resulting from MyChart messages that I fail to read in a timely manner.

I agree that all communication through MyChart will be in regard to my own health condition(s). I understand that contents of any message may be stored in my permanent medical record. I understand that asking for advice on behalf of another person could potentially be harmful and is a violation of the MyChart terms of use. The Service Provider does not assume any responsibility for health information or services used by persons other than the MyChart enrollee.

MyChart ID and Password

I understand that I will create a unique identification (ID) code and password to be used to access my health information via MyChart. I understand that this ID and password are unique codes that identify me in the StemExpress MyChart computer system. Inquiries and entries that I make via MyChart will be logged with my identity.

I understand that it is extremely important that I keep the ID and password that I use to access MyChart completely confidential. If at any time I feel that the confidentiality of my password has been compromised, I will change it by going to the Password link on the StemExpress MyChart website. I understand that the Service Provider takes no responsibility for and disclaims any and all liability or consequential damages arising from a breach of medical record confidentiality resulting from my sharing or losing my password. If the Service Provider discovers that I have inappropriately shared my password with another person, or that I have misused or abused my StemExpress MyChart access privileges in any way, my participation in MyChart may be discontinued by the Service Provider without prior notice.

Verification of Identity

I understand that my enrollment is contingent on verification of my identity either in person by a StemExpress employee or physician, or based on successfully answering identity verification questions generated by Experian’s PreciseID service.

Minor Eligibility

An individual must be age 18 or older to request a personal MyChart account. Parents or guardians of minor children may request access to the minor child's account by following the terms outlined in the "Proxy Access" section of this Terms and Conditions statement. Minor children between the ages of 12 and 17 (inclusive) will not be eligible to participate in MyChart services. Under State and Federal law, there are certain types of medical information that the parent or guardian of a minor patient age 12 or older may not view without consent of the minor patient. StemExpress does not gather these types of protected medical information on minor patients. Thus, a parent or guardian of a minor patient can request proxy access up until the patient is 18. When a minor patient reaches age 18, proxy access is revoked.

Proxy Access

Individuals may request proxy access to a minor’s (under the age of 18) MyChart account by completing the Proxy Access portion of the MyChart Consent Form and submitting it to StemExpress. Such access will only be granted to parties with parental rights or legal guardianship over the MyChart account holder and only to the extent that the party requesting proxy access can demonstrate the legal right to account holder's medical information. A MyChart account will be activated for both the proxy and the account holder. If the proxy’s legal relationship with the account holder changes, the proxy must inform the clinic immediately by calling StemExpress Member Services at (530) 626-7000, or sending written notice to StemExpress, Attention MyChart, 1739 Creekside Drive, Suite 100, Folsom, CA 95630. StemExpress reserves the right to revoke proxy access at any time for any reason. When a minor patient reaches age 18, proxy access is automatically revoked.

Security and Confidentiality

StemExpress is committed to protecting the confidentiality of your medical information. We limit StemExpress employees’ access and ability to enter or view information based upon their role in your care. Firewalls, passwords, encryption, and audit trails are further used to safeguard your information. We shall identify the records released and note the time and date of access each time a patient accesses MyChart. We have taken steps to make all information received from our online visitors as secure as possible against unauthorized access and use.

Disclaimer

I understand that StemExpress MyChart may not be available to me all the time due to system failures, back-up procedures, maintenance, or other causes beyond the control of the Service Provider. Access is provided on an “as-is, as-available” basis and the Service Provider does not guarantee that I will be able to access MyChart at any particular time.

I UNDERSTAND THAT THE SERVICE PROVIDER TAKES NO RESPONSIBILITY FOR AND DISCLAIMS ANY AND ALL LIABILITY ARISING FROM ANY INACCURACIES OR DEFECTS IN SOFTWARE, COMMUNICATION LINES, VIRTUAL PRIVATE NETWORK, THE INTERNET OR MY INTERNET SERVICE PROVIDER (ISP), ACCESS SYSTEM, COMPUTER HARDWARE OR SOFTWARE, OR ANY OTHER SERVICE OR DEVICE THAT I USE TO ACCESS MyChart. During times when MyChart is unavailable, other communication methods (e.g., telephone) should be used to access my health information at StemExpress.

Surveys

I understand that from time to time I may be asked to complete patient satisfaction surveys via MyChart. StemExpress may analyze information submitted via MyChart as part of descriptive (demographic) studies and reports. In such cases all of my personal identifying information will be removed.

Release of Information Request

I authorize StemExpress to release my personal health information to me via MyChart. I understand that due to California Health & Safety Code Section 123148, medical providers are prohibited from releasing the following laboratory results via MyChart, even though a patient may consent to their release: “HIV antibody test; presence of antigens indicating a hepatitis infection; abusing the use of drugs; test results related to routinely processed tissues, including skin biopsies, Pap smear tests, products of conception, and bone marrow aspirations for morphological evaluation.” I understand that access to my health information is for my use only, and that I may call StemExpress for a more detailed explanation of laboratory test results received via MyChart. I understand that I may revoke this authorization at any time in writing, and that I have a right to receive a copy of this authorization upon request.
